All images on this website are copyrighted.
Any copying, usage and/or distribution is strictly prohibited.
Searching
> We have endeavored
to create an easy to search database for our growing collection of images.
As you can see there are numerous categories to browse. You can also enter
keywords in the search box to narrow your choices. We have embedded keywords
into all the image collections to respond to more selected searches. The
scope of your search results will be determined by your selection of keywords.
> Quick Search -
By default the system uses "Match at least one keyword" for the quick search
function. If you input "beautiful sunset" (without the quotes) into the
quick search field, then the search function will return results for any
media that contain either "beautiful" OR "sunset" in its properties.
The system supports the "AND" and NOT" operands in the quick search function
by the use of the plus sign (+) and minus sign (-) respectively in front
of the keywords.

If you input "beautiful +sunset" (without the quotes)
into the search field, the system will only return results for any media
that contain both keywords "beautiful" AND "sunset" in its properties.

If you input "beautiful "sunset" (without the quotes)
into the search field, the system will return results for any media
that contain the keyword "beautiful", but this media can't contain the
keyword "sunset" in its properties.

Note: There must not any spaces between the
second keyword and the input operands (+), (-) keywords.
> Advanced
Search - The advanced search function
doesn't use the same algorithms as above. It offers options allowing you
to choose which operand you want to use for your searches.
There are three options available.

Match at least one keyword
The system will return results for any media that contain either one
of the input keywords in its properties.

Match all keywords
The system will only return results for any media that contain all input
keywords in its properties.

Match exact phrase
The system will only return results for any media that contains the
exact input keyword phrase in its properties.
Payment Method
> You will need to
tell our shopping cart which payment method you would like to use to pay
for your purchases. By default the payment method is PPP (pay per purchase).
Using this payment method you will need to pay during the checkout process.

The Lightbox
> The Lightbox is
YOUR collection of images. You may add up to 30 images to your lightbox.
If you wish to purchase an image that is in your lightbox, click on the
thumbnail to view the enlarged image. Select the items that you want to
purchase and click on the "add to cart" button.
Shopping Cart
> The shopping cart
displays your order details, if you wish to delete an image from your order
before proceeding to checkout, simply hit the remove link on the right side.
Checking Out
> You will need to
login to checkout your order. If you are new to the site please complete
the registration form and agree to our terms and conditions, to create a username and password. This information
is stored, so that you can return to the site to make future purchases and
so that we can review your orders.
> We utilize
PayPal for purchases made on this site.

Giclee Print
>The word Giclée (“g-clay”), is derived from the French verb gicler meaning "to squirt or spray", Giclée, is used to describe a fine art digital printing process combining pigment based inks with high quality archival quality paper to achieve an inkjet print of superior archival quality, light fastness and stability.
> The process involves squirting or spraying microscopic dots of pigment-based ink onto high quality art paper or canvas. The image is colour corrected to attain the closest possible match to the original work if required. The digital information is fine tuned to the type of paper or surface on which the image is to be printed, further ensuring fidelity to the original.
> Giclées are printed on a variety of substrates or mediums, the most common being watercolour paper or canvas. Image permanence is a concern to artists and collectors. Estimates are based on laboratory simulations of aging to give a fade & colour shift resistance of up to 200 years in ideal conditions, tests developed and conducted by Epson.

Terms and Conditions of Sale
Please read the following terms and conditions ("the Terms") carefully. By placing an order with us you shall be deemed to have accepted the Terms and your order shall, together with the Terms, constitute the contract between the parties ("the Contract").
Our acceptance of any order placed by you shall at all times be subject to these Terms, unless otherwise agreed in writing by us.
Definitions
"We"/"us"/"our" means the Chris Windsor Photography (a company registered in England and Wales, whose registered office is at 75 Bedford Avenue, Barnet, Hertfordshire, EN5 2ES.)
"You"/"your"/"yours" means you, the Customer
"the Goods" means the goods to be sold under the Contract between the parties.
1. Characteristics of the Goods
1.1 We will do our best to ensure that colour toning of monochrome prints is to a consistent standard and that, in the case of colour images, colour balance is maintained within acceptable professional tolerances.
1.2 As colour matching is a largely subjective process, exact matching cannot be guaranteed. Colours may vary from screen to screen, and from screen to print, due to the colour set-up of individual computers and screens. For these reasons, colours may vary slightly from those shown on the Chris Windsor Photography Limited website at www.chriswindsorgallery.co.uk ("the Website") or otherwise shown to you at the time of ordering and we accept no liability for such variation. All descriptive literature including colour illustrations are therefore approximate and do not constitute a trade description. For the avoidance of doubt, you agree that you do not rely on any description when entering into the Contract.
1.3 Unless otherwise stated, we use a fine art digital printing process combining pigment-based inks with high quality archival quality paper to achieve an inkjet print of superior archival quality, light fastness and stability. Our prints are created using Epson 4800 or 9600 printers with Epson Ultrachrome K3 inks, which with the 8-channel print head is capable of producing a wide tonal range and colour gamut.
1.4 Giclée printing offers both a softness and richness of colour and we will endeavour to ensure that the print represents the original work in the closest possible way.
1.5 In the case of framed prints, our framer creates bespoke frames for all our fine art prints. All frames are made to order and are made with wooden mouldings sourced from sustainable forests, and all waste is recycled.

2. Order methods and enquiries
Print sales from this site are by mail order only. We are, however, happy to deal with enquiries by e-mail, fax, or telephone during normal office hours. To order by phone, please call UK + 44 (0) 20 8449 9495.
3. Basis of sale
3.1 All Goods are supplied subject to availability. If the Goods you want are not available, we shall, at your request, advise you of alternatives at the time prior to you placing an order.
3.2 We may at our discretion add, vary or withdraw Goods listed on the Website, or on any other literature, electronic or otherwise, published by us, at any time without notice.
3.3 All reasonable efforts have been made to ensure that the details, descriptive information, and specifications of the Goods are as accurate and up to date as possible.
3.4 All print sizes quoted are approximate and do not necessarily represent exact dimensions. We shall endeavour to meet specific instructions on image dimensions wherever practicable.
3.5 Any errors or omissions on the Website, or on any other literature, electronic or otherwise, published by us shall be subject to correction, without any liability accruing to us.
3.6 You shall be solely responsible for the accuracy of all orders, and shall not rely on our knowledge, skill and judgement.
3.7 We reserve the right to change the specification (without detracting from the quality) of the Goods ordered at our sole discretion.

4. Prices
4.1 Prices shown in our price lists, order forms, and elsewhere are guide prices only and are exclusive of delivery costs, VAT, and sales tax. While these are the prices which shall normally apply, we reserve the right to change them without notice, or to adjust the prices of individual purchases in the light of any special circumstances or any additional work which may be necessary to meet your specific requirements.
4.2 Where a special price is deemed necessary by us, we shall not proceed with the order without your prior agreement.
5. Payment
5.1 All sales are subject strictly to our receipt of payment with your order.
5.2 Delivery costs, VAT and sales tax shall be added to your order as applicable, depending on your country.
5.3 We accept all major credit cards (via PayPal card processing services) but not debit cards. We also accept payment by cheque (if drawn on a UK bank), or UK postal order or money order. Cheques must be cleared before work is undertaken and dispatched. Cheques shall be made payable "Chris Windsor Photography". In the event that you pay by cheque and your cheque bounces, you shall be liable for all reasonable costs incurred by us as a result.
5.4 For orders from outside the UK, payment shall be by credit card (via PayPal in our Shopping Cart facility).

6. Formation of Contract
6.1 The Contract shall be formed by our acceptance of an order placed by you for the Goods.
6.2 You will be deemed to have placed an order when you give your credit or debit card details to us.
6.3 We will be deemed to have accepted your order by sending an email confirmation ("the Confirmation") of your order directly to you.
7. Delivery and dispatch
7.1 Packaging and shipping charges cover normal UK surface mail and airmail to Europe, the USA, and other areas and these charges are added to each order. (We ship unframed prints anywhere in the world, and framed prints anywhere in mainland United Kingdom.)
7.2 We use acrylic rather than glass for deliveries of framed work to ensure your art arrives in perfect condition. Customers collecting artwork in person can select glass or acrylic.
7.3 We aim to deliver within 28 days of receipt of your order. We will endeavour to deliver sooner, but please allow 28 days, as work is produced to order. In the event that we cannot deliver to you within 28 days, we will notify you promptly. For orders outside the UK, please allow slightly longer than 28 days for your order to arrive.
8. Damaged goods and refunds
8.1 Notification of damage to Goods in transit or faulty goods must be sent to us within 7 days of receipt by you of the Goods.
8.2 Damaged or faulty Goods must be returned to us within 7 days of receipt by you for examination. Return shipping charges are your responsibility,
8.3 The Goods must be returned in their original packaging. We shall accept no liability for claims for damaged or faulty Goods in the event that the Goods are not returned in their original packaging.
9. Order cancellation and refunds
9.1 If, for any reason, you are not satisfied with a print order, you may cancel your order in writing and return the Goods to us in perfect condition, in their original packaging, within 14 days of the date of placing your order and we will refund the purchase price and delivery charge (unless provided for under a separate contract).
9.2 In accordance with the Consumer Protection (Distance Selling) Regulations 2000, we will not accept returns or issue refunds for cancellation of orders for custom sizes, custom finishes, frames (unless faulty, in the event of which Clause 8 shall apply).
9.3 In the event of you cancelling your order, return shipping charges are your responsibility. You must notify us in writing prior to returning the Goods and we will give you specific return instructions.

10. Guarantee
Our policy is one of continuous development and improvement. For this reason, and to allow for fluctuations in the supply or availability of materials, we reserve the right to vary the photographic materials, chemistry, mounting or framing materials, adhesives or packaging used in connection with any photographic print. We guarantee that all materials used, if not precisely as advertised, will be of a quality at least equal to the advertised specification.
11. Liability
11.1 Our sole liability to you will be to replace or refund the price of Goods damaged in transit at our sole discretion.
11.2 Except for death or personal injury caused by us, we shall not be liable for any representation, implied warranty, condition or other terms or duty in common or at common law, for any consequential loss or damage, costs or expenses of whatever nature which arise from the supply of Goods or their use or resale unless expressly provided in these Terms.
12. Intellectual property rights
All of our images are the copyright of Chris Windsor. Any purchase from us of photographic prints, or reproductions of our images in any other form, specifically excludes any right to copy or reproduce those images (including in digital, or other electronic format, or in any other format whatsoever) for commercial or private use. All infringements of copyright will be vigorously pursued.
13. Force majeure
We shall not be liable to you or deemed to be in breach of the Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to the Services, if the delay or failure was due to any cause beyond our reasonable control, including, but not limited to, Acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
14. Waiver
No delay or failure by us to exercise any of our powers, rights or remedies under the Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them.
15. Notices
All notices to be given under the Terms will be in writing (which may include email) signed (digitally, in the case of email) by or on behalf of the party giving it and shall, unless delivered personally, be left at, or sent to, the address of the recipient, or to any other address the recipient may designate by notice in accordance with this Clause. Notices may be delivered personally by hand, by first class pre-paid letter, by facsimile transmission, or by email. Any notice given under the Terms shall be deemed served if delivered personally, on delivery; if sent by first class post, two clear days after the date of posting; and if sent by facsimile or e-mail, when despatched.
16. Severability
If any part of the Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

17. Entire agreement
The Terms constitute the entire agreement between the parties with respect to their subject matter and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between the parties hereto.
18. Authorisation
You acknowledge and agree that the person agreeing to the Terms is authorised to do so and shall bind you to all the terms and conditions contained herein, and you represent and warrant that such person is acting within the scope of his or her authority as an officer, director, duly authorised agent or employee of yours.
19. Governing law and jurisdiction
The Contract shall be governed by and construed in accordance with English law and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.
